Can I walk away from my Florida home if I can’t make the mortgage payments, and I don't want to deal with the Florida short sale process or loan modification in Florida?
You can walk away, but there are ramifications. First of all, there may be a solution that could save your home and give you a payment substantially lower than the one you currently have. Walking away without doing anything will result in the court entering a final judgment of foreclosure and your home being sold. Further, the bank will have the right to seek a deficiency judgment against you for the difference between what you owe and what the house sells for.
Literally just moving out would not be a wise idea n most circumstances. First off, even if its not possible to save your home, you may end up living in your home fir 2 to 3 years, maybe longer while we fight for you in court. In the meantime, if the bank violates the law by calling you or by failing to to provide information upon request, we may be able to sue them for you and obtain a monetary recovery against them. so, while we fight your foreclosure, you may get thousands of dollars from the bank if they violate the law.
We offer free consultations with our foreclosure lawyers in our offices located in Plantation / Fort Lauderdale, Delray Beach, Coral Gales, and North Miami Beach.
